I sold my land. Subject to finance by the 19th Feb 2010, settlement to take place 6th March 2010. 4 days before settlement(02/03/10), my conveyancer calls me to tell me that she just received a fax dated 25th Feb stating that the purchasers application for finance has been declined!!! Up until the 19th Feb, we heard nothing from anyone so everyone assumed all was going to plan. Starting 21st Feb, we started to make big expenses as after the settlement, we would be able to pay off these expenses. Upon receiving the decline fax, my conveyancer calls agent to ask if he has the deposit of $20500. He says he only has the $500 and has been trying to get them to pay the rest but to no avail!!! Who's at fault? Who can i sue for my deposit and the extra expenses i had incurred due to the delay in settlement? Does the conveyancer have to chase up the deposit? I could really use some input from the more experienced horse people. My husband and I are looking to move. I have a horse, we're looking for a place with a barn. I work full time. So this place is up for sale on 38 acres, a 30 stall barn, indoor, several paddocks and about 40 horses. The fences need to be fixed, I wonder how much of a train wreck some of the horses are (health wise, etc) and there are some issues with the barn. So here are some things wrong with the place: 1. In the part of Florida that I live, there is only one range with four stalls. It is expensive as well as run down. People go there only because they have no other place to go within a 50 mile radius. I decided I want to open a range myself and have already obtained so much data that my head is spinning, yet I still have some questions I am having trouble getting answered. I have the Florida State Statutes, County Codes and Zoning, The NRA Range Sourcebook (in the mail), USAF ETL 08-11: Small Arms Range Design and Construction, the EPA CFRs for lead, and have a couple of properties I am looking at in my area that meet code and would be large enough to suffice the range. The range will be an outdoor range that has 50m (X5), 100 m (X5), 300 m(X3), and 1000 m (X2) lanes that will have use a dirt backstop accompanied by a cement block wall. The range will allow for ammunition from .22 cal to .50 cal. Other than delivery of dirt my brother, cousin, dad, and friend will assist me in the construction of the stalls, measuring the Surface Danger Zone/Vertical Danger Zone, backstops, and targets. My cousin and myself are going to Orlando to become Range Safety Officers for insurance purposes. As business takes off I will be adding a skeet shoot and a tactical/obstacle course with pop-up targets and CQB scenarios, but those are not in the making yet (not until I have an established business). The building where business will be conducted will need to have retail space for accessories, gear, ammo, and guns for sale/rent (I have an application for an FFL but until I have a location of business I cannot send it in). I will also need a 125ft X 125ft room for conducting NRA, CCW, and security courses as well as offer free hunting courses (All but the hunting courses will be taught by either myself or my cousin). A bathroom and breakroom are requirements for a security training facility in my state. I know what is needed by the county, state, EPA, and BATFE in regards to licensing and regulations for the range and firearms, what I am not sure of is the business aspect. I was hoping someone who owns a range in Florida could help answer the few questions that I have left. Q1: I know the average mark-up for firearms and accessories in the area, but how can I find the cost of the firearms and accessories (wholesale/dealers price) or of any price breaks for bulk orders? The distributors will not talk to me until I have my FFL and I cannot get my FFL without a place for business and I cannot get a place of business without a business loan from a bank. Due to the economy and my age, 24, I am going to have to go to the bank with a DETAILED business plan and explain how they will get there money back. Q2: How do you pay a business loan back? Do you pay monthly payments (i.e. mortgage/car payment) or do you pay in back in a lump some with in so many years? If so what is the time frame it is to be paid back in? Q3: Do you know of any good insurance companies to cover my business (in Florida) and if so how much does it cost? Again they will not talk to me until I have a business. Q4: How much do lead removal services cost? The EPA mandates that a company has to come and remove lead from my dirt back stops and I'm sure it is not free. If I have the equipment am I allowed to do it myself? Q5: If you own an outdoor range in Fl, do you mind telling me an estimated cost of construction supplies for your outdoor range? Q6: I am looking a buying a large piece of land and I'm probably not going to find one with a building on it that suits my needs. Any ideas/suggestions on new construction vs. other options I am unaware of such as portable buildings (if they have them) Q7: What are the state and federal taxes (estimate of course) for running such a business in FL? I landed an interview for a new position at the same company where I'm currently at. The interview was back on Feb 23 (Tuesday). They told me that they should reach the final decision by the end of the week. I sent a thank you email to the HR and the department manager the very next day (24th). I called the HR on March 1 and she said that the manager is out and have not given her the final decision yet. I am thinking about relocating.. I want to be in the suburbs or just outside of.. rural..but not too much. Safety is a huge concern. Where I live in Wisconsin the crime is very very low. The roads are not at all whatsoever congested. Which is why there are hardly any car accidents. I like that and will miss both. However.. I fell in love with the beauty of Oregon. Wisconsin has beauty also.. I would actually consider staying.. if there were more jobs and less brutal winters. There is a lot of land here.. but the tornado threats scare me. I got a new land line from AT&T about four months ago, and I constantly get calls for Dan and Cindy Whatever. The worst thing is it's all autodialers. Relentless computers from collection agencies, credit cards, time shares, "special offers." There seems to be no way to stop them. I did the common sense thing for about 2 months and said, "I'm sorry. This is a new number. You can't reach that person here anymore." A lot of times the guy on the other end would pursue this sale in spite of the fact that he was calling entirely the wrong person. Regardless, they just keep calling. I stopped being polite about a month ago, but still told people it was the wrong number. I got on the government "do not call" list, but I can't see that it has done anything. I mostly just hang up or don't answer now. I have had to unplug my phone line and go back to using my cell. I don't see what I can do since they don't respond to me telling them they have the wrong number. The government "do not call" list doesn't stop them from calling Cindy and Dan because it only stops unsolicited calls. Clearly Cindy and Dan did solicit these calls. They just dumped the phone number on the next unfortunate bastard, me. I don't want to talk to every person who calls me and threaten each and every one of them with legal pursuit if they don't honor the do not call list. It's just too much. I am not going to pay an additional $10/month to get call ID and call block. This was supposed to be a cheap way to phase out my cell phone. The only thing I can thing to do is call BellSouth and ask to have my number changed or just quit the service. In the part of Florida that I live, there is only one range with four stalls. It is expensive as well as run down. People go there only because they have no other place to go within a 50 mile radius. I decided I want to open a range myself and have already obtained so much data that my head is spinning, yet I still have some questions I am having trouble getting answered. I have the Florida State Statutes, County Codes and Zoning, The NRA Range Sourcebook (in the mail), USAF ETL 08-11: Small Arms Range Design and Construction, the EPA CFRs for lead, and have a couple of properties I am looking at in my area that meet code and would be large enough to suffice the range. The range will be an outdoor range that has 50m (X5), 100 m (X5), 300 m(X3), and 1000 m (X2) lanes that will have use a dirt backstop accompanied by a cement block wall. The range will allow for ammunition from .22 cal to .50 cal. Other than delivery of dirt my brother, cousin, dad, and friend will assist me in the construction of the stalls, measuring the Surface Danger Zone/Vertical Danger Zone, backstops, and targets. My cousin and myself are going to Orlando to become Range Safety Officers for insurance purposes. As business takes off I will be adding a skeet shoot and a tactical/obstacle course with pop-up targets and CQB scenarios, but those are not in the making yet (not until I have an established business). The building where business will be conducted will need to have retail space for accessories, gear, ammo, and guns for sale/rent (I have an application for an FFL but until I have a location of business I cannot send it in). I will also need a 125ft X 125ft room for conducting NRA, CCW, and security courses as well as offer free hunting courses (All but the hunting courses will be taught by either myself or my cousin). A bathroom and breakroom are requirements for a security training facility in my state. I know what is needed by the county, state, EPA, and BATFE in regards to licensing and regulations for the range and firearms, what I am not sure of is the business aspect. Q1: I know the average mark-up for firearms and accessories in the area, but how can I find the cost of the firearms and accessories (wholesale/dealers price) or of any price breaks for bulk orders? We signed papers with a closing date upon approval of the rear property lines and all was going fine till the county didn't approve the survey. In the mean time the people buying our house want us to pay their rent. I agree someone should pay but I don't feel it should be us since I feel our Realtor didn't protect us in this manner. This money was then divided up between the 8 cousins after legal and selling fees were deducted. My question is, (1) I believe the 1099S sent to the cousins after the sale for tax year 2009 reflected the current sales price and not the fair market value at the time of death so was this done incorrectly. (2) what portion of this sale affects your adjusted gross income, just any gain or loss from what the original fair market value of the house was at the time of death or will the whole portion of her share (approximately $6,500.00) be considered income and reflect so on her adjusted gross income and will this raise or lower her AGI. (3) Would it be illegal for tax purposes for her mother to have rented this house out while it was in a trust and it is unknown if this income was reported since she herself has since passed away but would this have any outcome on the correct amount that would be reflected on my girlfriends AGI this tax year if it was not reported. ok so my mom bought some land in el paso, texas back in 1993. she paid it off and she is trying to sell this property now but we have a problem. the title company has advised us that the warranty deed is not in my moms name but the previous owner's name. they are wanting us to locate this person who my mom has not had contact with in more than 15 years to get them to sign some papers to change the warranty deed. I formed an LLC for my real estate investment business that do both buying/selling of land/single family home, as well as rental of those homes. Do I report this as business code 531110 Rental Real Estate or 531390 Other Real Estate Activities, or some other code? Also, how should I report these rental and sales proceeds income?
